These Terms of Service govern your use of Purchester.com and the Purchester platform. By accessing or using our service, you agree to be bound by these terms.

1. Aceptación de los términos

By creating an account or using Purchester, you confirm that you are at least 18 years old, have the legal capacity to enter into contracts, and agree to these Terms. If you are using Purchester on behalf of a company, you represent that you have authority to bind that company.

2. Registro de cuenta

Debes proporcionar información exacta al registrarte. Eres responsable de mantener la seguridad de tus credenciales de acceso. Infórmanos de inmediato si sospechas que se ha producido un acceso no autorizado. Podemos suspender o cancelar las cuentas que infrinjan estos Términos.

3. Anuncios y responsabilidades de los vendedores

Los vendedores deben proporcionar descripciones exactas, incluida la información sobre el estado, las especificaciones y los defectos conocidos. Está prohibido publicar artículos prohibidos, falsear las características de los productos o manipular la plataforma. Los vendedores son responsables de completar las ventas y enviar los artículos tal como se describen.

4. Responsabilidades de los compradores

Los compradores deben completar las compras que inicien. El pago debe efectuarse al finalizar la compra. Los compradores son responsables de verificar que los productos sean adecuados para el uso previsto. Las devoluciones de cargos o disputas de pago iniciadas sin contactarnos primero pueden provocar la suspensión de la cuenta.

5. Tarifas y pagos

Purchester charges a volume-based platform fee on each transaction, deducted from seller payouts and charged to buyers at checkout. Seller fees start at 7.99% and decrease as cumulative volume grows, down to 2.99% for enterprise accounts. Buyer fees start at 4.99% and decrease similarly. Current fee tiers are displayed on the pricing page. Where Escrow Payments is used, an additional Escrow Payments fee of 1% per transaction applies (or a flat subscription of $299.99/month). We reserve the right to update fee rates with 30 days' notice. Subscription fees are billed in advance and non-refundable except as required by law.

6. Conductas prohibidas

You may not use Purchester to conduct fraud, money laundering, or illegal activity; circumvent our fee structure; harass other users; scrape or copy the platform; or list items that are stolen, export-controlled without proper authorization, or otherwise illegal to sell.

6a. Transacciones fuera de la plataforma

Soliciting or completing transactions outside of the Purchester platform is strictly prohibited. This includes — but is not limited to — sharing contact details (phone number, WhatsApp, Telegram, WeChat, email, or any other channel) with the intent to close a deal off-platform, instructing a buyer to cancel and repurchase through an external channel, accepting direct bank transfers or cash as payment for a Purchester listing, and linking to external storefronts or personal websites as a workaround to avoid platform fees. Any attempt to circumvent the platform transaction system — regardless of the channel used — is grounds for immediate listing removal and permanent account termination. Purchester monitors messaging and listing content for off-platform solicitation signals.

7. Propiedad intelectual

Purchester owns or licenses all platform content including design, code, and editorial content. You retain ownership of content you submit (listings, photos) but grant Purchester a worldwide license to display and promote it. Do not upload content you do not have rights to.

8. Protección del comprador de Escrow Payments

Escrow Payments is Purchester's optional buyer protection service. When enabled at checkout, funds are held by Stripe on behalf of Purchester until the buyer confirms receipt or the auto-release window expires. Auto-release fires 30 days after confirmed delivery for Escrow Payments users, or 90 days after delivery for transactions where Escrow Payments was not activated. Manual-release mode allows the buyer to hold funds until they are satisfied the item matches the description. Buyers may freeze funds and open a dispute at any time during the hold window. Escrow Payments does not guarantee item quality — it guarantees the payment process. Purchester is not a party to the underlying sale.

9. Resolución de disputas

Transaction disputes between buyers and sellers should first be resolved directly. If unresolved, contact our support team. Purchester may mediate but is not obligated to resolve private disputes. Decisions by Purchester in disputes are final for platform purposes.

10. Limitación de responsabilidad

Purchester is a marketplace platform and is not a party to transactions between buyers and sellers. We are not liable for the quality, safety, or legality of listed items. Our total liability for any claim is limited to the fees you paid to Purchester in the 12 months preceding the claim.

11. Exenciones de responsabilidad

Purchester is provided 'as is' without warranties of any kind. We do not guarantee continuous availability, error-free operation, or that the platform will meet your requirements. Use of the platform is at your own risk.

Purchester publishes AI-assisted editorial content including news articles, research paper summaries (Education / Papers), and buying guides (Guides). This content is for informational purposes only and does not constitute professional, legal, financial, or technical advice. We do not guarantee the accuracy of AI-generated summaries. Research paper summaries link to original sources and do not re-host copyrighted material.

13. Cambios en los términos

Podemos actualizar estos Términos en cualquier momento. Los cambios sustanciales se notificarán por correo electrónico o mediante un aviso en la plataforma. El uso continuado una vez que los cambios entren en vigor constituye la aceptación de estos. Si no aceptas los Términos revisados, debes dejar de utilizar la plataforma. 14. Ley aplicable

Estos Términos se rigen por las leyes de Polonia y de la Unión Europea cuando corresponda. Cualquier disputa estará sujeta a la jurisdicción de los tribunales de Katowice, Polonia, salvo que las leyes de protección del consumidor de tu jurisdicción exijan lo contrario.
