These Terms of Service govern your use of Purchester.com and the Purchester platform. By accessing or using our service, you agree to be bound by these terms.

1. Aceitação dos termos

By creating an account or using Purchester, you confirm that you are at least 18 years old, have the legal capacity to enter into contracts, and agree to these Terms. If you are using Purchester on behalf of a company, you represent that you have authority to bind that company.

2. Registro da conta

Você deve fornecer informações precisas ao se registrar. É responsável por manter a segurança das credenciais da sua conta. Notifique-nos imediatamente se suspeitar de acesso não autorizado. Podemos suspender ou encerrar contas que violem estes Termos.

3. Anúncios e responsabilidades dos vendedores

Os vendedores devem fornecer descrições precisas, incluindo condição, especificações e defeitos conhecidos. É proibido anunciar itens proibidos, deturpar produtos ou manipular a plataforma. Os vendedores são responsáveis por concluir as vendas e enviar os itens conforme descrito.

4. Responsabilidades dos compradores

Os compradores devem concluir as compras que iniciarem. O pagamento deve ser efetuado no checkout. Os compradores são responsáveis por verificar se os produtos são adequados ao uso pretendido. Estornos ou contestações de pagamento iniciados sem nos contatar primeiro podem resultar na suspensão da conta.

5. Taxas e pagamentos

Purchester charges a volume-based platform fee on each transaction, deducted from seller payouts and charged to buyers at checkout. Seller fees start at 7.99% and decrease as cumulative volume grows, down to 2.99% for enterprise accounts. Buyer fees start at 4.99% and decrease similarly. Current fee tiers are displayed on the pricing page. Where Escrow Payments is used, an additional Escrow Payments fee of 1% per transaction applies (or a flat subscription of $299.99/month). We reserve the right to update fee rates with 30 days' notice. Subscription fees are billed in advance and non-refundable except as required by law.

6. Condutas proibidas

You may not use Purchester to conduct fraud, money laundering, or illegal activity; circumvent our fee structure; harass other users; scrape or copy the platform; or list items that are stolen, export-controlled without proper authorization, or otherwise illegal to sell.

6a. Transações fora da plataforma

Soliciting or completing transactions outside of the Purchester platform is strictly prohibited. This includes — but is not limited to — sharing contact details (phone number, WhatsApp, Telegram, WeChat, email, or any other channel) with the intent to close a deal off-platform, instructing a buyer to cancel and repurchase through an external channel, accepting direct bank transfers or cash as payment for a Purchester listing, and linking to external storefronts or personal websites as a workaround to avoid platform fees. Any attempt to circumvent the platform transaction system — regardless of the channel used — is grounds for immediate listing removal and permanent account termination. Purchester monitors messaging and listing content for off-platform solicitation signals.

7. Propriedade intelectual

Purchester owns or licenses all platform content including design, code, and editorial content. You retain ownership of content you submit (listings, photos) but grant Purchester a worldwide license to display and promote it. Do not upload content you do not have rights to.

8. Proteção ao comprador do Escrow Payments

Escrow Payments is Purchester's optional buyer protection service. When enabled at checkout, funds are held by Stripe on behalf of Purchester until the buyer confirms receipt or the auto-release window expires. Auto-release fires 30 days after confirmed delivery for Escrow Payments users, or 90 days after delivery for transactions where Escrow Payments was not activated. Manual-release mode allows the buyer to hold funds until they are satisfied the item matches the description. Buyers may freeze funds and open a dispute at any time during the hold window. Escrow Payments does not guarantee item quality — it guarantees the payment process. Purchester is not a party to the underlying sale.

9. Resolução de disputas

Transaction disputes between buyers and sellers should first be resolved directly. If unresolved, contact our support team. Purchester may mediate but is not obligated to resolve private disputes. Decisions by Purchester in disputes are final for platform purposes.

10. Limitação de responsabilidade

Purchester is a marketplace platform and is not a party to transactions between buyers and sellers. We are not liable for the quality, safety, or legality of listed items. Our total liability for any claim is limited to the fees you paid to Purchester in the 12 months preceding the claim.

11. Isenções de responsabilidade

Purchester is provided 'as is' without warranties of any kind. We do not guarantee continuous availability, error-free operation, or that the platform will meet your requirements. Use of the platform is at your own risk.

Purchester publishes AI-assisted editorial content including news articles, research paper summaries (Education / Papers), and buying guides (Guides). This content is for informational purposes only and does not constitute professional, legal, financial, or technical advice. We do not guarantee the accuracy of AI-generated summaries. Research paper summaries link to original sources and do not re-host copyrighted material.

13. Alterações nos termos

Podemos atualizar estes Termos a qualquer momento. Alterações relevantes serão comunicadas por e-mail ou aviso na plataforma. A continuidade do uso após a entrada em vigor das alterações constitui aceitação. Se você não concordar com os Termos revisados, deverá parar de usar a plataforma. Entre em contato conosco se tiver alguma dúvida.

14. Lei aplicável

Estes Termos são regidos pelas leis da Polônia e da União Europeia, quando aplicável. Quaisquer disputas estarão sujeitas à jurisdição dos tribunais de Katowice, na Polônia, exceto quando as leis de proteção ao consumidor da sua jurisdição exigirem o contrário.
